The Maryland Daily Record has the story. A sharply divided Maryland high court ruled this week that police officers may briefly stop and question a person who smells of marijuana though possession of less than 10 grams of the drug is not a crime in the state. In its 4-3 decision, the Court of Appeals said the drug’s aroma provides police with “reasonable suspicion” that the person may have 10 grams or more, thus permitting the officers to conduct a brief “investigatory” stop.
