Cannabis lawyers are heading to Brussels next week to challenge a recent decision by the European Union to reclassify food products containing cannabidiol (CBD) and prohibit their sale. A food can be considered ‘novel’ if it was not consumed by humans to any significant degree prior to May 1997. Our position remains unchanged.

The compound was found in a Switzerland-manufactured branded food product/sleep aid labeled ‘CBN Night’. According to the report, HHC does not necessarily comply with Good Manufacturing Practices (GMPs), and therefore consumers may be exposed to unforeseen risks, such as contamination caused by “extraction residues or synthetic by-products.”

Separating the elements of the plant into various compounds certainly makes sense from this perspective – not to mention the fact that the industry is already coming up with products that use certain compounds alone (see pure THC or CBD extract as just two examples of the same), or even combine the same in new ways.
