Epidiolex, an FDA-approved medication containing CBD (cannabidiol), has been listed as Schedule 5 by the DEA since June 25th, 2019. The doctor who writes the prescription must be licensed and has to write it for a specific patient, as opposed to prescribing general instructions for treatment. Cannabis is a schedule 1 substance.

Drug Enforcement Administration (“DEA”) to reschedule marijuana. As we all know, the DEA has routinely refused to accept or denied each and every petition, minus one that yielded very specific changes for a synthetic cannabis drug. Per the usual course, the DEA filed a motion to dismiss for failure to exhaust administrative remedies.

Although the DEA refuses to remove marijuana from the schedule 1 list, the Farm Bill is considered to be the most important victory in the history of U.S. In 2016, Tennessee legalized the use of CBD containing no more than 0.9% This does not however, mean that all CBD products are now legal.

Cannabis is not a “gateway” drug, according to the ASA and the DEA’s own statements cited in the August 2016 U.S. That a patient had exhausted all other “recognized traditional treatment options available for condition” before turning to medical cannabis as a therapeutic medicinal treatment. .
