In Texas, the House Committee on Criminal Jurisprudence passed a marijuana decriminalization bill out of committee this week. Under state law, adults face civil penalties for minor marijuana possession offenses. Legislation is pending, House Bill 1383, that would decriminalize certain marijuana possession offenses.

Colorado Dispensary Loses Tax Case. A Colorado dispensary was being audited by the IRS and the IRS used the Colorado Marijuana Enforcement Tracking Reporting and Compliance system that tracks cannabis sales to determine that it was in violation of its tax reports. The proposal is expected to bring $165 million annually after 2023.

The language encourages the Office of Personnel Management (OPM) to review its policies and guidelines regarding the hiring and firing of individuals who use marijuana off-the-job in states where that individual’s private use of marijuana is no longer prohibited under state law. The law takes effect on January 11, 2020.
