Alert: U.S. Hemp Roundtable Sends Follow-Up Comments To VA Hemp Task Force

Last week, the U.S. Hemp Roundtable (USHR) sent a follow-up letter with additional comments to the Virginia Hemp Task Force as a response to its recent draft report regarding the safe and responsible manufacture and sale of hemp extracts and other substances containing tetrahydrocannabinol (THC) intended for human consumption. As we shared on November 8th, the report weighs heavily on testimony provided by USHR General Counsel, Jonathan Miller, who presented to the Task Force during its second meeting on August 9th.

Consistent with previous comments sent on July 5th and August 2nd, the USHR continues to advocate for a regulatory framework that distinguishes non-impairing, non-intoxicating hemp products from intoxicating, impairing products sold under the guise of hemp, and more importantly protects consumers by assuring access to quality, regulated products.

Although we are encouraged by some of the suggestions and recommendations in the report and appreciate the Task Force’s acknowledgement of industry’s concerns, we have identified areas of improvement that we believe will help achieve an appropriate balance between consumer safety and access, including —

  • Assessing a product’s legality using its Total THC concentration
  • Coordinating cannabis regulation and enforcement
  • Requiring a permit to sell certain hemp products
  • Establishing civil, not criminal penalties
  • Removing child-resistant packaging requirements and 21+ age restrictions from non-intoxicating products
  • Asking the legislature for the development of a new, adult-only, enhanced regulatory lane for intoxicating hemp derivatives
 


The USHR appreciates the VA Hemp Task Force — a statutorily-created commission of leading state government officials — for focusing on the safe and responsible manufacture and sale of hemp products in the state. We would also like to thank Jason Amatucci and the Virginia Hemp Coalition for their advocacy and support. This collaborative effort will help provide the best possible guidance to members of the VA General Assembly making regulatory decisions for us next session.
