Canadian Judge Says Quebec Can’t Prohibit Home Cultivation

MONTREAL — A court has invalidated the provisions of Quebec’s cannabis law prohibiting home cultivation of the drug. Quebec Superior Court Justice Manon Lavoie ruled Tuesday that Quebec’s legislation infringed upon the jurisdiction of the federal government, which has sole responsibility for legislating on criminal matters. The judge ruled unconstitutional the sections of the Quebec Cannabis Regulation Act prohibiting the possession and the cultivation for personal purposes of cannabis plants.

The Woodstock City Council approved an ordinance on Tuesday establishing a 3% tax on the gross sales receipts of recreational marijuana retailers. As part of the new law legalizing recreational marijuana, which takes effect in January, municipalities may impose up to a 3% tax on marijuana-based retailers. Council voted, 5-1, in favor of the proposal, with council member Darrin Flynn voting against it.

The measure went up for a vote Tuesday night and passed, allowing Urbana to both become one of the first cities in Illinois to create the tax and also meet an end-of-September deadline for reporting taxation plans to the Illinois Department of Revenue. Urbana staff believe the Municipal Cannabis Retailer’s Occupation Tax could be a boon for state cities, according to The News-Gazette.

The proposal to change marijuana taxes passed unanimously. The measure — tentatively being called measure 1B — is a restructuring of marijuana taxes that would provide about $3.5 million annually. The measure would raise marijuana sales tax from 3.5% to 6%, which would align Pueblo County with other rates in the state. It would also keep the existing allocations to the scholarship program.
