HB5604 ‘Excluded offense’ amendment matches SB3287
Sen. Robert Peters introduced on Feb. 7 Senate Bill 3287, which would amend provisions for background checks and prohibit employed individuals from having been convicted of an “excluded offense.” Late Friday, Rep. Kam Buckner introduced a House Bill 5604, which mirrors the same provisions as SB3287.
HB5604 and SB3287 replace existing provisions concerning background checks with provisions requiring the Illinois State Police to conduct a criminal history record check of the prospective principal officers, board members, and agents of a medical cannabis dispensing organization or cultivation center applying for a license or agent identification card under the Act.
HB5604 and SB3287 amend the Compassionate Use of Medical Cannabis Program Act by deleting in three locations the phrase, “has not been convicted of an excluded offense.”
Another provision amends the Cannabis Regulation and Tax Act and provides that “nothing in the Act shall be construed to prevent or otherwise inhibit an otherwise qualified individual from serving as a principal officer or agent of a cannabis business establishment on the sole basis of a nonviolent criminal conviction related to cannabis.”
