In Finland, there has been a ban on CBD for some time, despite the rulings of the European Commission and the European Court of Justice that determined that CBD is not a drug and free trade is allowed. ” SUPREME ADMINISTRATIVE COURT STATED THAT KANNAWAY PURE GOLD HEMP OIL IS NOT A MEDICINAL In 2018, Finnish customs confiscated a bottle of Kannaway Pure Gold, claiming it had been illegally imported since FIMEA, the Finnish Medicines Agency, lists CBD as a medicinal ingredient, leading Finnish customs to take a “general approach” to treating all CBD products such as medicines.
On Friday, October 22, 2021, the Finnish Supreme Administrative Court declared that, according to EU guidelines, each product must be classified as a medicine on a case-by-case basis with specific claims on therapeutic effects, dosage and supporting evidence. In this case, the Supreme Administrative Court has ruled that Kannaway Pure Gold hemp oil is not a medicine.
“This is a huge win for Kannaway. Certainly, the European hemp industry will also benefit, but we are proud that it is our company that took action, fought the battle and won.
We hope this sets an important precedent for other EU jurisdictions where national medicines agencies hold a similar view,” said Kannaway International Managing Director Janne Heimonen in the press release. “We have been fighting for years to prove that we are not selling drugs under the law, but that our CBD oil is a dietary supplement.”
