MISSION STATEMENT

The Montana Department of Revenue administers almost 40 state taxes, property appraisals, liquor laws, and cannabis law for the state of Montana. The Director’s Office Division provides support for the Director and department employees relating to tax policy, legal, human resources, training, enterprise planning, communications and taxpayer assistance, dispute resolution, call center, accounting and budgeting, contracts, facilities and purchasing, and security.

DUTIES
The Tax Counsel handles the most complex, legally and financially significant, and diverse cases in the department. Senior lawyers must be able to handle the most difficult and important cases without assistance. The cases typically require extensive investigation, research, and preparation. The incumbent will either act as sole representative or may serve as lead counsel. The majority of cases are before Bankrupty Court, the department’s Office of Dispute Resolution, Montana Tax Appeal Board, Montana District Courts, and the Montana Supreme Court. However, cases may also be before federal appellate courts such as the Ninth Circuit Court of Appeals and the U.S. Supreme Court. The incumbent is relied upon by the Chief Legal Counsel as an expert on litigation matters and on legal matters affecting a wide variety of state and federal constitutional legal issues, agency policies, in-state and out-of-state bankruptcy and collections, and activities including general tax policy. The position reports to the Chief Legal Counsel and does not supervise other staff.

Qualifications:


EDUCATION / EXPERIENCE

The above knowledge, skills, and abilities are acquired through completion of a Juris Doctorate degree from an accredited
law school and six years of job-related work experience. Must be licensed to practice law in the state of Montana.

  • Work experience should be made up of increasingly responsible legal practice providing an intimate knowledge of the acutal practice of law and litigation especially in the area of state and federal constitutional law.
  • Advanced legal courses in the area of state and local taxation and administrative law, training in trial techniques, post-trial record analysis and briefing; ability to digest and analyze large factual records, experience identifying matters pertinent to the issues on appeal, and experience organizing the same into a coherent, well-organized work product, strong oral advocacy skills and experience arguing at the appellate court level are preferred.
  • IAAO certification on hire preferred; must complete IAAO course work within 3 years of hire, unless waived by Chief Legal Counsel.
