A New York senator has filed a bill to make it so transgender and non-binary people can qualify as social equity applicants under the state’s marijuana law.
Sen. Jeremy Cooney (D) introduced the legislation in an attempt to resolve an “unintended consequence” of the adult-use law, which would currently “force certain individuals from choosing between their gender identity and receiving priority for a license,” the bill’s justification section states.

7517 2021-2022 Regular Sessions I N S E N A T E November 12, 2021 ___________ Introduced by Sen. COONEY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the cannabis law, in relation to including gender equal- ity in the social and economic equity plan of the New York state cannabis control board THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraphs (e) and (f) of subdivision 2 of section 87 of the cannabis law are amended and a new paragraph (g) is added to read as follows: (e) distressed farmers, as defined in subdivision five of this section; [and] (f) service-disabled veterans[.]; AND (G) TRANSGENDER AND GENDER-NONBINARY INDIVIDUALS. § 2. Subdivision 5 of section 87 of the cannabis law is amended by adding a new paragraph (h) to read as follows: (H) "TRANSGENDER AND GENDER-NONBINARY INDIVIDUALS" SHALL MEAN ANY PERSON WHO HAS A GENDER IDENTITY OR EXPRESSION DIFFERENT FROM THE SEX ASSIGNED TO THAT INDIVIDUAL AT BIRTH. § 3. This act shall take effect immediately.
