This Tuesday the decree that regulates the cultivation of cannabis for medicinal use in Mendoza was published in the Official Gazette . With the signature of Governor Rodolfo Suarez, the province will add the activity to the production matrix respecting health protocols and within a framework of legal security. During the debate on this regulation in the Legislature, social organizations stated that there were several points that were left adrift. They maintain that this provincial law does not contemplate self-cultivation or solidarity cultivation, among other things, aspects that are covered by national legislation, already regulated.
The provincial government highlighted that Mendoza became the first province to enact a law that involves economic aspects and that also understands the productive chain in pursuit of human health. In fact, it already had a pioneering Law in the country, No. 8962 that allowed the medicinal use of cannabis derivatives for patients with refractory epilepsy.
The provincial authorities had been working on the research, regulation, control and productive operation of medicinal cannabis. In December 2020, the provincial Legislature passed Law 9,298, adhering to National Law 27,350, which allows medical and scientific research, the use and cultivation of the plant and its derivatives.
This national regulation (No. 27350) on the Medicinal Use of Cannabis , published in the Official Gazette in November, not only allows self-cultivation, but also extends its use to other diseases (since the original text only contemplated the consumption of cannabis medicinal for those with refractory epilepsy). At the same time, it guarantees the provision for patients, encourages research and authorizes the public and private production of oil and other derivatives.
At the Opening of Ordinary Sessions of Congress, President Alberto Fernández assured this Monday that he will promote a project of “use of cannabis cultivation for industrialization purposes for medicinal and industrial use.
