It’s been a minute since we wrote about the new OLCC tax compliance rules for retailers. These temporary rules require all retailers to certify tax compliance via the Oregon Department of Revenue (DOR) in order to renew or transfer ownership of a marijuana retailer license. From this week’s experience, I have some good news to share.

The OLCC announced several changes to the tax compliance rule this weekend at the Cannabis & Psychedelic Section of the Oregon Bar Association’s annual conference (where I was pleased to moderate a panel on the failures of legalization). On June 15, 2023, the OLCC approved temporary rules requiring marijuana retailers to obtain a Certificate of Tax Compliance (“Certificate”) from the Oregon Department of Revenue (“DOR”) as a condition for acquiring or renewing a marijuana retailer license, as well as for changes of ownership and adding someone to a license.

Sales fell (again) along with licensee numbers (for the first time) According to OLCC data , retail sales between January 1, 2023 and November 30, 2023 clocked in at $874 million. For the most recent three months of 2023, we’ve hovered at a respectable $745/lb. By my math, the state is on pace for roughly $953 million this year.
