The Drug Enforcement Administration (DEA) quietly confirmed last year that the seeds of cannabis—because they contain less than .3% THC (cannabis’ psychoactive ingredient) on a dry-weight basis—are in fact, legal, under the 2018 Farm Bill. That means cannabis seeds can be sold openly and without criminal liability. Today, though, few breeders have taken up the administration on that suggestion, as this acknowledgement has created a state-federal disconnect in the regulation of cannabis seeds.
