Special Presentation
Unauthorized and Unwise:
The Lawful Use Requirement in Trademark Law

Wednesday, July 21st, 11 a.m. PDT (CLE Available)

For decades, the United States Patent and Trademark Office (PTO), has required trademark owners to comply with sundry non-trademark laws governing the sale of their trademarked goods and services. Pursuant to this “lawful use requirement,” the agency has refused, or even canceled the registration of thousands of marks used on everything from schedule I controlled substances to mislabeled soap.

Join INCBA Founding Board Members Mary Shapiro and Shabnam Malek, along with Vanderbilt Professor and Cannabis Legal Expert Rob Mikos, for a deep examination of the Lawful Use Requirement as applied to cannabis.
Together, they will explore how this application obfuscates the USPTO’s primary mandate, and why the agency’s lawful use requirement has no place in trademark law. This Special Webinar is for CLE Credit.
