Maine Office Of Marijuana Policy Publishes 3 New Guidance Documents + Latest Cannabis Updates From The State Authorities

The Office of Marijuana Policy (OMP) recently issued a series of guidance memoranda related to a range of topics affecting the Adult Use Marijuana Program (AUMP).

Earlier this month, OMP filed a “proposed rule” with the Secretary of State to replace the current medical program rules and will now conduct a public hearing and a written public comment period per the Maine Administrative Procedures Act, the standard process for implementing laws administered by a state agency.

Governor Mills Issues Executive Order Extending Certain Adult Use Conditional Licenses
Earlier this month, Governor Janet T. Mills signed Executive Order 34 FY 20/21, An Order Extending the Term of Conditional Adult Use Marijuana Establishment Licenses.

The order contains the following language: “The term of conditional adult use marijuana establishment licenses issued pursuant to 28-B M.R.S. § 205 shall be extended June 30, 2021, or until the expiration date listed on the conditional adult use marijuana establishment license, whichever is later.”

In accordance with the order, all adult use conditional licenses with an expiration date of June 29, 2021 or earlier have been automatically extended by OMP to June 30, 2021.

Conditional license holders participating in the local authorization process with their host municipality may wish to refer municipal officials to the governor’s executive order. Additionally, stakeholders with licenses originally expiring from March 15, 2021 through June 29, 2021 may contact OMP’s licensing division to request a reissued conditional license with the June 30, 2021 expiration date.

OMP Issues Marijuana Public Health and Safety Campaign Request for Proposals
The State of Maine is seeking proposals for the development and implementation—by a public entity, private entity, or combination of the two—of programs, initiatives and campaigns focused on increasing the awareness and education of the public on health and safety matters relating to the use of marijuana and marijuana products, including, but not limited to, programs, initiatives and campaigns focused on preventing and deterring the use of marijuana and marijuana products by persons under 21 years of age.

Proposals must be submitted to the State of Maine Division of Procurement Services, via e-mail, at: Proposals@maine.gov.  Proposal submissions must be received no later than 11:59 p.m., local time, on Wednesday, April 14, 2021.  Proposals will be opened the following business day. Proposals not submitted to the Division of Procurement Services’ aforementioned e-mail address by the aforementioned deadline will not be considered for contract award.
