LCB Board Action: Specific Cannabis Interim Policies Withdrawn

On September 29, 2021, during a regularly scheduled meeting, the Liquor and Cannabis Board took the following actions on these Board Interim Policies (BIP):

Liquor Policies Rescinded (Withdrawn):

LCB Policy Number 00-4 about exceptions to liquor license fee refund procedures. The purpose of the policy was to establish a standard procedure for refunding liquor license fees to license holders who, for various reasons, may be prohibited from continuing the sale of liquor based on a court decision, or changes in state or local laws where the licensed premise is located. This policy went into effect in 2000, and had not been used since 2003. It is no longer necessary and was rescinded.

Rescinded Board Interim Policy 08-2015 about beer/wine gift delivery licenses. This policy outlined requirements for internet sales and delivery of beer and wine. Rules to implement this policy went into effect September 9, 2017, therefore this BIP is no longer necessary.

Rescinded Board Interim Policy 02-2017 on private label spirits. This policy clarified requirements of production for private label spirits between a distiller, craft distiller, or sprits certificate of approval holder and a spirits retail licensee. Rule to implement this policy became effective May 5, 2017, and this BIP is no longer necessary.

Marijuana (Cannabis) Policies Rescinded (Withdrawn)

Rescinded Board Interim Policy 03-2014 regarding marijuana food processing facility inspection. This policy required marijuana processors producing marijuana-infused products in a food processing facility (as required in LCB rule), to pass a processing facility inspection. It also gave guidance on compliance inspections for marijuana processors who produced marijuana infused products. Rules to implement this policy went into effect in June 2015 and this BIP is no longer necessary.

Rescinded Board Interim Policy 09-2014 on adult-use/recreational marijuana. This BIP focused on the implementation of 2014 legislation (ESHB 2304) about how marijuana concentrates could be produced and sold in LCB-licensed marijuana production and retail facilities. Rules to implement this BIP went in to effect on June 20, 2015 and this BIP is no longer necessary.
